1. Scope, Definitions

These General Terms and Conditions (hereinafter "GTC") of Thomas Feiner,
acting under "Institute for EEG Neurofeedback" (hereinafter "Organizer"), apply to
all contracts for participation in courses / seminars / webinars (hereinafter "Event"), concluded by a consumer or entrepreneur (hereinafter "Customer") with the Organizer regarding the Events shown on the website of the Organizer. This is the inclusion of the Customer's own terms contradicted, unless otherwise agreed.

Entrepreneur in the sense of these terms and conditions is a natural or legal person or
a legal partnership, who or which in entering into a legal transaction does so in exercise of his or its trade, business or profession.

Consumer in the sense of these terms and conditions is any natural person who enters into a legal transaction for a purpose that does not correspond with their independent professional work.

2. Services of the Organizer

The Organizer offers both online and in-class Events. The content of the Event results from the respective course description on the Website of the Organizer.

For online Events, the Organizer provides its services exclusively in electronic form via online video conference using appropriate technical means. For this purpose, the Organizer provides the Customer with suitable application software before the start of a video conference. To participate in the online video conference without any problems, the Customer’s system must meet certain minimum requirements. The Organizer will communicate instructions and minimum requirments via the Website. The costumer takes responsibility for compliances with the system requirements. The Organizer is not liable for technical problems that are due to inadequate system requirements of the Customer.

In presence Events, the Organizer provides its services exclusively in personal contact with the Customer and in from him selected premises. Unless otherwise stated in the course description of the Organizer, the Customer has no claim to the selection of a particular venue to carry out the desired Event.

The Organizer provides its services by carefully selected and well trained staff. The Organizer can also use the services of third parties (subcontractors) who act on its behalf. Unless otherwise stated in the course description of the Organizer, the Customer has no claim to the selection of a specific person to carry out the desired Event.

The Organizer provides his services with the utmost care and to the best of his knowledge and belief. However, the Organizer does not owe a certain success. In particular, the Organizer does not warrant that the Customer sets a certain learning success or that the Customer reaches a certain performance goal. This is not least dependent on the personal commitment and will of the Customer, on which the Organizer has no influence.

4. Validity of the Registration

Upon receipt of the registration, the Customer will immediately receive a confirmation by e-mail with an invoice. This means that upon receipt of this written confirmation, participation in the seminar is considered as agreed and the place booked as firm.

5. Course Fees

The course fees of the Institute for EEG Neurofeedback (hereinafter: „IFEN“) are exempt from VAT in accordance with § 4 no. 21 letter a double letter bb UStG.
Costs for travel, accommodation and meals at in-class Events are not included in the price and to be borne by the Customer, unless mentioned differently in the course description.

These are the following payment options:

a. PayPal

During the online booking process, the Customer has the opportunity to make the payment immediately after submitting the booking via PayPal. At the end of the booking process, the Customer will be redirected directly to PayPal by clicking on "Pay now with PayPal". There it is possible to make the payment, after the registration with the access data has been made at PayPal.
When paying by means of a payment method offered by PayPal, the payment is processed via the payment service provider:

b. Bank Transfer

If the Customer does not use the offered down-payment option, it is possible to pay the course fee by bank transfer.
The course fee is to be transferred to the following account:

Course fees and fees for internship and supervision are to be paid immediately after booking.
If advance payment has been agreed by bank transfer, the payment is due immediately upon conclusion of the contract, unless the parties have agreed on a later due date.
The Customer is requested to indicate the invoice number and name in the „note to payee“ field. The amount of the course fee can be taken from the invoice.

6. Early Bird Discount

If the Customer wants to use an early bird discount in the form of a price reduction up to a certain date, he informs the Organizer of the desired early bird discount with the online booking using the message box and transfers the corresponding amount in due time as indicated in the course description. After verification of the receipt of payment, the invoice will be adjusted to the early bird discount and the participant will receive the corrected invoice by e-mail.

7) Reward Certificates

If the Customer has a reward voucher, the registration should not be made via the website, but a non-formal email with contact details and the course date. The Organizer will contact the Customer as soon as possible. Any bills with an early bird price automatically generated by online booking are invalid. Invoices with bonus vouchers are created exclusively manually.

8) Teaching Material

The provider is the owner of all rights of use, which are necessary for the execution of the Event. This also applies with regard to teaching materials which may be provided to the Customer in connection with the Event.
In the case of online Events, course-accompanying teaching material (eg teaching materials) is provided to the Customer exclusively in electronic form via the webinar, by e-mail or for download. Unless otherwise agreed, the Customer has no claim to the transfer of the teaching material in physical form.

9) Cancellation Guarantee at Events

a. Representative

A representative may be appointed at any time instead of the registered participant. There are no additional costs for the Customer.

b. Change of Booking

A change of booking to another event date or another event is possible at any time. The Customer is requested to inform the Organizer of the change in writing, text form is sufficient. There are no additional costs for the Customer.

c. Change in performance

In the event of a significant change in performance, the Customer may withdraw from the contract free of charge or, instead, request participation in an at least equivalent other Event if the Organizer is in a position to do so. There are no additional costs for the Customer.

The Customer must assert the rights in accordance with the above clause immediately after the information of the Organizer about the change of service.

d. Cancellation

A withdrawal from the contract is possible at any time. A withdrawal must be done in writing, text form is sufficient. The following processing fees are being charged:

- Cancellation is possible up to 30 days before the start of the Event (only once) without any additional costs
- Cancellation up to 2 weeks before the start of the Event: Euro 100
- Cancellation from two weeks before the start of the Event: 30% of the participation fee, max. Euro 750,-
The Customer is kindly advised to cancel any existing hotel bookings as well.

10) Cancellation by the Organizer

The Organizer reserves the right to cancel the course due to insufficient demand or number of participants (at the latest 10 days before the scheduled date of the event) or for other important reasons for which the Organizer is not responsible (eg illness of the presenter, force majeure). For already paid participation fees the Customer will be issued a voucher. The Organizer will endeavor to cancel the event for a replacement date.
Further liability and damage claims that are not related to injury to life, limb or health are excluded unless intent or gross negligence on the part of the Organizer. The Customer is kindly advised advised to observe this also for any hotel bookings as well as flight or train tickets.

11) Consumer Withdrawal Rights

This offer from the Institute for EEG Neurofeedback is aimed at consumers and businesses.
Are you an entrepreneur, viz. a natural or legal person or a legal partnership, which acts in the conclusion of the legal transaction in the exercise of their commercial or independent professional activity, the following remarks on the right of withdrawal do not apply to you.
If you are a consumer, the legislator demands the following information about the right of withdrawal. Here, a consumer is any natural person who concludes a legal transaction for purposes which are predominantly neither commercial nor independent professional activities.

a. Withdrawal Rights

The consumer has the right to withdraw from this contract within fourteen days without giving reasons.
The revocation period is fourteen days from the date of the contract.

You need JavaScript enabled to view it.) must be informed by means of a clear statement (eg a letter sent by post, fax or e-mail) about the decision to withdraw from this contract. The use of the enclosed withdrawal sample form is optional.
To maintain the cancellation period, it is sufficient that a notice of the exercise of the right of withdrawal is sent before the expiry of the withdrawal period.

b. Withdrawal Consequences

If this Agreement is revoked, the Promoter has to repay all payments received from the Customer, including delivery charges (except for the additional costs arising from the fact that the Customer chose a different delivery than the most favorable standard delivery offered by IFEN) immediately and at the latest within fourteen days from the date on which the notice of cancellation of this contract is received by the Organizer. For this repayment, the same means of payment used in the original transaction will be used unless otherwise expressly agreed with the Customer; In no case will the Customer be charged for this repayment charges.
If the right of withdrawal has been waived, since the service (training) begins during the cancellation period, then the corresponding provisions of these terms and conditions apply.

12) Alternative Dispute Resolution

The EU Commission provides a platform for online dispute resolution on the internet at the following link:

This platform serves as a point of contact for the out-of-court settlement of disputes arising from online purchases or service contracts in which a consumer is involved.
The seller is neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.

13) Final Clauses

The place of performance for seminars is the respective venue. Jurisdiction is Munich. All legal relationships between the Customer and IFEN shall be governed by German law, excluding UN sales law.
Should individual provisions of these terms of use be invalid, the validity of the remainder remains unaffected. In place of the invalid provision, a provision comes closest to the economic purpose of the ineffective provision. The same applies to any gaps in these terms of use.
