1. Scope, definitions
These general terms and conditions (hereinafter "GTC") of Thomas Feiner, trading under the name "Institut für EEG-Neurofeedback" (hereinafter "Organizer"), apply to all contracts for participation in courses / seminars / webinars (hereinafter "Event") that a consumer or entrepreneur (hereinafter "Customer") concludes with the Organizer with regard to the events presented on the Organizer's website. The inclusion of the Customer's own terms and conditions is hereby contradicted, unless otherwise agreed.
An entrepreneur within the meaning of these Terms and Conditions is a natural or legal person or a partnership with legal capacity, which, when concluding a legal transaction in
exercise of their commercial or independent professional activity.
A consumer within the meaning of these terms and conditions is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.
2. Services of the organizer
The organizer offers both online and face-to-face events. The content of the event is determined from the respective course description on the organizer's website.
For online events, the organizer provides its services exclusively in electronic form via online video conference using appropriate technical means. To this end, the organizer provides the customer with suitable application software before the start of a video conference. In order to participate in the online video conference without errors, the customer's system must meet certain minimum requirements, which are communicated to the customer on the organizer's website. The customer is responsible for compliance with the system requirements. The organizer is not liable for technical problems that are due to inadequate system requirements on the part of the customer.
For face-to-face events, the organizer provides its services exclusively in personal contact with the customer and in premises selected by the customer. Unless the organizer's course description states otherwise, the customer has no right to select a specific room to hold the desired event.
The organizer provides its services through qualified personnel selected by it. The organizer can also use the services of third parties (subcontractors) who work on its behalf. Unless the organizer's course description states otherwise, the customer has no right to select a specific person to carry out the desired event.
The organizer provides its services with the greatest care and to the best of its knowledge and belief. However, the organizer is not obliged to achieve a specific result.
In particular, the organizer does not guarantee that the customer will achieve a certain learning success or that the customer will reach a certain performance goal. This depends not least on the personal commitment and will of the customer, over which the organizer has no influence.

4. Validity of registration
After registration has been received, the customer will immediately receive a confirmation by email with an invoice. This means that upon receipt of this written confirmation, participation in the seminar is deemed to have been agreed and the place is firmly booked.
5. Course fee
The course fees of the Institute for EEG Neurofeedback (hereinafter: “IFEN”) are exempt from sales tax according to Section 4 No. 21 letter a double letter bb UStG.
Costs for travel, accommodation and meals for face-to-face events are not included in the price and must be borne by the customer, unless otherwise stated in the organizer's course description.
The following payment options are available:
a. PayPal
During the online booking process, the customer has the option of making the payment via PayPal immediately after submitting the booking. At the end of the booking process, the customer is redirected directly to PayPal by clicking on "Pay now with PayPal". There it is possible to make the payment after logging in with the PayPal login data.
When paying using a payment method offered by PayPal, payment processing is carried out via the payment service provider

b. Transfer
If the customer does not use the immediate payment option offered, it is also possible to pay the course fee by bank transfer.

Course fees and fees for internship and supervision must be paid immediately after booking.
If prepayment by bank transfer has been agreed, payment is due immediately after conclusion of the contract, unless the parties have agreed on a later due date.
The customer is requested to state the invoice number and name as the intended purpose when making payment. The amount of the course fee can be found on the invoice.
6. Early bird discounts
If the customer wants to use an early bird discount in the form of a price reduction up to a certain date, he or she informs the organizer of the desired early bird discount using the message field when booking online and transfers the corresponding amount on time as stated in the course description. After checking that the payment has been received, the invoice will be adjusted to reflect the early bird discount and the participant will receive the corrected invoice by email.
7. Reward vouchers
If the customer has a reward voucher, registration should not be done via the website, but via an informal email stating contact details and the course date. The organizer will contact the customer as soon as possible. Any invoices with early bird prices automatically generated by online booking are invalid. Invoices with reward vouchers are only created manually.
8. Teaching materials
The provider is the owner of all usage rights required to hold the event. This also applies to teaching materials that may be provided to the customer in connection with the event.
For online events, course-related teaching materials (e.g. teaching materials) are made available to the customer exclusively in electronic form via the webinar, by email or for download. Unless otherwise agreed, the customer has no right to receive the teaching materials in physical form.
9. Cancellation guarantee for events
a. Representation
A representative can be appointed at any time in place of the registered participant. There are no additional costs for the customer.
b. Rebooking
A rebooking to another event date or another event is possible at any time. The customer is requested to inform the organizer of the rebooking in writing; text form is sufficient. There are no additional costs for the customer.
c. Change in performance
In the event of a significant change in service, the customer may withdraw from the contract free of charge or instead choose to participate in an at least equivalent
another event if the organizer is able to offer such an event from its range at no additional cost to the customer.
The customer must assert the rights according to the above paragraph immediately after informing the organizer about the change in service.

d. Cancellation
Withdrawal from the contract is possible at any time. Withdrawal must be made in writing, text form is sufficient. The following processing fees will be charged:
Cancellation up to 30 days before the start of the event is possible (only once) without additional costs.
Cancellation up to 2 weeks before the start of the event: Euro 100,- plus VAT (Euro 119,- incl. VAT)
Cancellation from two weeks before the start of the event: 30% of the participation fee plus VAT, max. Euro 750,- plus VAT (Euro 892,50 incl. VAT)
The customer is politely advised to also cancel any existing hotel bookings.
10. Cancellations by the organizer
The organizer reserves the right to cancel the course due to insufficient demand or number of participants (at least 10 days before the planned event date) or for other important reasons for which the organizer is not responsible (e.g. illness of the speaker, force majeure). The customer will be issued a voucher for participation fees already paid. If the event is cancelled, the organizer will endeavor to find an alternative date.
Further liability and compensation claims that do not concern injury to life, body or health are excluded unless there is intent or gross negligence on the part of the organizer. The customer is politely advised to also observe this for any hotel bookings as well as flight or train tickets.
11. Right of Withdrawal for Consumers
This offer from the Institute for EEG Neurofeedback is aimed at consumers and companies.
If you are an entrepreneur, i.e. a natural or legal person or a partnership with legal capacity who, when concluding the legal transaction, is acting in the exercise of his or her commercial or independent professional activity, the following statements on the right of withdrawal do not apply to you.
If you are a consumer, the law requires the following information about the right of withdrawal. A consumer is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to their commercial or independent professional activity.
a. Right of withdrawal
The consumer has the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the date of the conclusion of the contract.
To exercise the right of withdrawal, the organizer (Institute for EEG Neurofeedback IFEN, Karl-Böhm-Straße 50, 85598 Baldham, Telephone: +49 (0)89 82 03 07 39, Fax: 03212 1035629740, Email: info@neurofeedback-info.de) by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of the decision to withdraw from this contract. The use of the attached Refund Request Form Templates is optional.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.
b. Consequences of revocation
If this contract is cancelled, the organiser shall refund all payments received from the customer, including delivery costs (with the exception of additional costs resulting from the customer choosing a different type of delivery than the cheapest standard delivery offered by IFEN), promptly and at the latest within fourteen days from the day on which the organiser received notification of the cancellation of this contract. For this refund, the same means of payment will be used that was used for the original transaction, unless something else was expressly agreed with the customer; under no circumstances will the customer be charged any fees for this refund.
If the right of withdrawal has been waived because the service (training) begins during the withdrawal period, the corresponding provisions of these General Terms and Conditions apply.

12. Alternative Dispute Resolution
The EU Commission provides a platform for online dispute resolution under the following link: https://ec.europa.eu/consumers/odr
This platform serves as a point of entry for the out-of-court settlement of disputes arising from online purchase or service contracts in which a consumer is involved.
We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
13. Final Provisions
The place of performance for seminars is the respective event location. The place of jurisdiction is Munich. German law applies to all legal relationships between the customer and IFEN, excluding the UN Convention on Contracts for the International Sale of Goods.
Should individual provisions of these terms of use be ineffective, the effectiveness of the remaining provisions shall remain unaffected. The ineffective provision shall be replaced by a provision that comes closest to the economic meaning and purpose of the ineffective provision. The same applies to any gap in these terms of use.
